How to Modify a Custody Order

Custody orders can be modified when there is a 'substantial change in circumstances' — a significant change that affects the child's welfare.

Common reasons include: a parent relocating, a parent's work schedule changing significantly, the child's needs changing (new school, medical needs), evidence of abuse or neglect, or a parent consistently violating the existing order.

To modify a custody order, you file a motion with the court that issued the original order. Both parents can agree to a modification (much cheaper) or it can be contested (requires a hearing)..
